Bill New's (1999) thoughtful paper has performed the valuable service of clarifying the meaning and the policy implications of paternalism. His careful formulation delimits the domain of justified state paternalism. Having argued successfully, in our view, for a narrow ambit, New proceeds to identify situations that justify paternalism. This comment is written in the spirit of a friendly reformulation that refines and improves the specification of when paternalism is justified. Our argument is two-fold. First, we argue that New's formulation, properly (...) understood, will not readily permit the paternalistic interventions he argues are justified. Second, we identify a class of potentially justified interventions that have paternalistic aspects, but which are neither strictly paternalistic nor market-failure remedies. (shrink)

Christopher Nolan’s Memento illustrates and explores two roles that memory plays in human life. The film’s protagonist, Leonard Shelby, cannot ‘make new memories’. He copes by using a ‘system’ of polaroids, tatoos, charts and notes that substitutes for memory in its first role, the retention of information. In particular, the system is supposed to help Leonard carry out his sole goal: to find and kill his wife’s murderer. In this it proves a disastrous failure. But are we so (...) very much better off? The film uses the failures of Leonard’s system to raise doubts about the effectiveness of our own psychological capacities for grasping the past. However, memory does more than allow us to retain information. As Richard Wollheim showed, it also enables the past to control our present, by perpetuating, while modifying, its affective hold over us. This is something wholly denied Leonard. By implicitly contrasting his position with ours in this respect, the film also explores this second role that memory plays in our lives. (shrink)

Apart from the ethical and legal grounds, there are good practical rea-sons to design more effective counterter-rorism measures. Preventable harms to population health contribute to mistrust and instability and undermine the stated objectives of the intelligence services.

A muddler naturally feels flattered by any kind of praise from the world of theory, as, for example, by Robert Scholes' generous remark that "muddling along, in literary theory as in life, is often more humane and even more efficient than the alternatives offered (...) by political, ethical, or aesthetic systems. We may in fact 'know' more than we can systematize about certain kinds of human behavior, so that our intuitions may indeed be superior to our more reasoned positions" . Are DRGs just? This is the primary question which this essay will answer. But there is a prior methodological question that also needs to be addressed: How do we go about rationally (non-arbitrarily) assessing whether DRGs are just or not? I would suggest that grand, ideal theories of justice (Rawls, Nozick) have only very limited utility for answering this question. What we really need is a theory of “interstitial justice,” that is, an approach to making justice judgments that is suitable (...) to assessing the social practices and institutions that comprise the interstices of our social life as opposed to its basic structure. Rawls's appeal to “our considered moral judgments” provides us with a useful starting point for this task, which we shall discuss in the first part of this essay. In the second part, we shall actually assess DRGs from the perspective of interstitial justice. What we shall show is that DRGs violate a large number of our considered judgments regarding a just approach to financing health care for the elderly in a cost-effective manner. This is true to such an extent that efforts to reform DRGs and make them fairer, such as the recent effort by Robert Veatch, should be abandoned. In the concluding section of the essay we discuss one especially pernicious feature of DRGs, namely, that they represent an invisible approach to rationing access to health care. In the minds of many this is one of the virtues of DRGs. That claim needs critical examination. (shrink)

Error is a neglected epistemological category in the history of science. This neglect has been driven by the commonsense idea that its elimination is a general good, which often renders it invisible or at least not worth noticing. At the end of the sixteenth century across Europe, medicine increasingly focused on “popular errors,” a genre where learned doctors addressed potential patients to disperse false belief about treatments. By the mid-seventeenth century, investigations into popular error informed the working methodology of natural (...) philosophers, rather than just physicians. In 1646, Thomas Browne published Pseudodoxia Epidemica, a large volume on popular error. Despite Browne’s formal training as a physician, this work examined only a few medical errors and instead aspired to be an encyclopedia of error. Pseudodoxia Epidemica was highly popular, running to six editions, and was known by the Fellows of the Royal Society. Influenced by Browne, alongside Bacon’s theory of the idols, natural philosophic practice in the late sixteenth and seventeenth century developed a focus on error that revised traditional attention to the discovery of knowledge. Fellows such as Robert Boyle and Robert Hooke proposed new ways to secure truth under the far-reaching influence of Bacon’s refutations of “natural human reason” distorted by false idols, of syllogistic logic, and of “theories,” his label for traditional philosophical systems that bias thought toward falsity. In three parts, this article traces the progression in early modern scientific approaches to handling error, and especially medical error – from physicians’ efforts to identify and eradicate it through collaborative effort, to the striking tension in Browne’s work between seeking to eliminate error while also showing a marked tolerance for it, to the Royal Society’s Baconian objective of instrumentalizing error to find truth. Error emerges as its own epistemic category that serves as a driving force toward knowledge production. (shrink)

The recent research of Helena Rosenblatt, Hilail Gildin, Arthur Meltzer, and John Scott calls for a reconsideration of Rousseau's stance towards and effect on the natural public law tradition. This reconsideration is especially called for given the persuasive evidence and arguments that these scholars marshal to demonstrate the positive contribution of Rousseau to that tradition and to suggest that his pre-Kantian rational law teaching in the Social Contract is rooted in his post-Hobbesian stance towards natural law, especially in the Second (...) Discourse. The work of these scholars builds upon others, especially on Leo Strauss, Victor Gourevitch, Jean Starobinski, Marc Plattner, Roger Masters and John Charvet, as well as Asher Horowitz, R. A. Leigh, Franz Haymann, and Robert Derathe, and completes the full range of alternative answers to our question. Their contributions are an invaluable scaffolding for fully grasping the issue and for proposing theses that could resolve it. Given the great debt owed to these scholars, the present inquiry begins with an overview and general assessment of their opinions on the issue, which is then followed by a close analysis of the relevant texts of Rousseau, especially the “Preface” to the Second Discourse. This paper compares the views of Hegel and Schelling regarding the problem of individuation, i.e. the question of what makes an individual (a) numerically distinct from others and (b) the very individual it is. My focus is on how Hegel approaches this problem in his metaphysics and how that relates to Schelling’s views as articulated in his ‘negative philosophy’. While Hegelians like Robert Stern and Karen Ng are optimistic that Hegel can solve the problem of individuation, I argue that (...) Schelling puts forward an objection that both challenges Hegel’s account and provides a rationale for taking seriously Schelling’s own insistence on a pre-logical dimension of being. (shrink)

This essay challenges a growing consensus among Aquinas scholars who attribute to him a pro-passion attitude, linking his virtue theory to accounts of emotion that see the emotions in a primarily positive light. There are good reasons for thinking Aquinas far more skeptical of the role to be played by emotion in the virtuous life—indeed, one can safely argue, in agreement with Aquinas, that the emotions are often threats to and so in need of control by the virtues. I focus (...) on the ideal of reason’s control over the emotions in the essay in contrast with the work of Robert Miner whose understanding of Aquinas on the passions and virtues tends to downplay the dominating role that reason plays in the moral theory of Aquinas. For Aquinas IRC is central to the normativity of the virtues that relate to the emotions. In contrast, Miner appears to minimize the need for the emotions to be controlled, which entails a certain elevation of the emotions to a nearly co-equal status with reason in Aquinas’s moral theory. Miner adopts two argumentative strategies to achieve this valorization of emotion in Aquinas, but I find both exegetically inaccurate and experientially deficient. (shrink)

Previous attempts to find meaning in emotional responses to music often begin with analysis of dynamic tonal patterns, with observation of the emotional behavior of listeners or with self-reports of emotional feelings. In this study, we begin with a somewhat detailed description of physical processes in the human auditory system that lead to the activation of processes in the autonomic nervous system, which produce embodied emotional responses to environmental challenges. We then propose an answer to the question: Why were some (...) of the same embodied responses that were originally adapted to meet the challenges of self-preservation and self-perpetuation in the course of human evolution coopted to serve as responses to perceived dynamic patterns in music? We find that a likely answer to this question involves uncertainties in the possible outcomes of antecedent or consequent musical events. (shrink)

Leonard Peikoff brought into Objectivist epistemology the doctrine that what is asserted arbitrarily (without adequate evidence) cannot be true or false. In 2008 the author gave a detailed critique of the doctrine; it has not received a published response. But there have been restatements by Harry Binswanger, Ben Bayer, and Gregory Salmieri. Their re-presentations do not refute any old arguments; their new arguments make the doctrine worse. The doctrine is being used to justify ignoring known possibilities, and to “prove” (...) that the current president of the United States has a parrot's mind in a human body. A theory of cognitive systems individuation is presented and defended. The approach has some affinity with Leonard Talmy's Overlapping Systems Model of Cognitive Organization, and the paper's first section explores aspects of Talmy's view that are shared by the view developed herein. According to the view on offer -- the conditional probability of co-contribution account (CPC) -- a cognitive system is a collection of mechanisms that contribute, in overlapping subsets, to a wide variety of forms of intelligent behavior. Central (...) to this approach is the idea of an integrated system. A formal characterization of integration is laid out in the form of a conditional-probabilitybased measure of the clustering of causal contributors to the production of intelligent behavior. I relate the view to the debate over extended and embodied cognition and respond to objections that have been raised in print by Andy Clark, Colin Klein, and Felipe de Brigard. (shrink)

Over the course of his distinguished career, Edward Weinshel has been a moral and intellectual force in contemporary psychoanalysis and an outspoken opponent of current trends in and out of the field toward dehumanization and deindividualization. _Commitment and Compassion in Psychoanalysis_, under the editorship of Robert Wallerstein, brings together 14 of Weinshel's major papers. The six clinical papers reprinted in this collection address the kaleidoscope of common personality organizations and propensities which, in their extreme variants, motivate individuals to seek (...) psychoanalytic assistance, covering topics that include "neurotic equivalents" of necrophilia, negation, lying, "gaslighting", perceptual distortion during analysis, and inconsolability. These clinical expositions are supplemented by eight theoretical papers in which Weinshel gives expression to the metapsychological paradigm of ego pyschology as it existed in the 70s and 80s. Four of the papers from the early 70s cover "the ego in health and normality," the transference neurosis, and various aspects of the training analysis. The remaining four papers, published between 1984 and 1992, chronicle Weinshel's notion of resistence as the clinical unit of the psychoanalytic process, his elucidation of specifically "psychoanalytic change" as it grows out of the psychoanalytic process, and his affirmation of modern conflict theory in the face of theoretical pluralism. Carefully edited by Robert Wallerstein and including an introductory essay by Leonard Shengold, _Commitment and Compassion in Psychoanalysis_ brings to contemporary debates the voice of a principled exemplar of the psychoanalytic calling. Balancing intellectual acuity with a profoundly caring temperament, and augmenting respect for the psychoanalytic tradition with a flair for original ideas, Edward Weinshel speaks to all who wrestle daily with the burdens, challenges, and healing promise of the impossible profession. Maurice Merleau-Ponty. Ed. Leonard Lawlor with Bettina Bergo. Trans. Leonard Lawlor. Evanston, IL: Northwestern University Press, 2002. Pp. 192. $19.95 pbk. The most striking characteristic of this volume is the manner that it presents layers of interpretation to the reader, particularly in that the writing is (...) not intended as a postmodern fête, and has limited value as a hermeneutic enterprise. Ultimately the book's true contribution is the seventy-nine pages devoted to the translation and printing of lecture notes used by [End Page 379] Merleau-Ponty in a class he gave at College de France, shortly before his death. However, the explanation of why this is so will have to be withheld until the end of this review.The course that Merleau-Ponty gave was organized around three essays published by Edmund Husserl. These essays are included in the volume reviewed here and must be briefly dealt with, as they are the core of whatever thinking occurs within and around this book. Interesting essays all, they deal with three longstanding issues of philosophical debate. The first essay challenges the classical notion of a transcendent ideal. Husserl attempts to show, through an examination of geometry, that an ideal is first called into existence when it is called into the realm of human experience, and he does this without ever resorting to the quality of detached being that Plato attributes to ideals. Then, in his second essay, Husserl attempts to defeat modernist cosmology, arguing, against Galileo, that the earth is a fixed point in the universe. Finally, his third essay hearkens back to Heraclitus and Parmenides, examining how human experience is able to extract a sense of atemporal quiddity in a world that is constantly falling into a past. A reader might be baffled that an intellectual could make such claims, but they are made from within the framework of phenomenology, and, within this paradigm as Husserl explains it, the claims he makes do not seem ridiculous at all. "The Origins of Geometry," "The Originary Ark, The Earth, Does Not Move," and "The World of the Living Present,"— these are the three essays that Merleau-Ponty forms his lecture course around. At sixty pages within this volume, they constitute one third of the text itself. For intellectual worth, I would say that these essays are the finest contribution in the text, but that claim is discounted because much of the essay material was already available in English translation. Nevertheless, it only makes sense to have it included in this volume in order to conveniently work back and forth between Merleau-Ponty's notes and Husserl's actual essays.However, that brings us to a significant problem within the text itself. If readers are like me, they will realize that it is often difficult to draw conclusions from the notes of others. Like secretarial shorthand, notes rely on a reader's ability to read both what has been written and what has been withheld in an expressive passage. There is no code that will allow us to recover what Merleau-Ponty recovered as he looked down on his podium at these notes and then raised his head to speak to his class. All that we have are the fragments, and they do not make a coherent argument, lacking both the clarity and the painstaking thoroughness that we find in books [End Page 380] such as The Phenomenology of Perception and The Visible and the Invisible. Certainly one cannot fault Merleau-Ponty for this—he did not write these notes for us, but for himself. His course might have been magnificent, even transcendent, but we will not know that from these fragments.I suppose it could be argued that the ambiguity inherent in such fragments liberates the text and opens it for some sort of radical hermeneutic exegesis; however, I sigh at the very thought of such an argument.
